Court ruling gives greater certainty to those drawing up neighbourhood plans

Planning magazine reports that the High Court has ruled that former planning minister Gavin Barwell acted lawfully in making a written ministerial statement (WMS) strengthening neighbourhood plans in council areas lacking a five-year housing supply.

Stephen Tapper, Planning Officers Society spokesman on neighbourhood planning, said the ruling gives greater certainty to planning authorities, developers and those drawing up neighbourhood plans. He said: "There was bitter disappointment in many neighbourhoods when they had prepared a plan and a developer was able to use the previous rules to force another 100 homes on them. Hopefully this will be a step forward in maintaining greater confidence in neighbourhood planning."
