Pre-commencement conditions can be proactive

According to the government briefing note that provided background to the recent Queen's Speech, a key focus of a new Neighbourhood Planning and Infrastructure Bill will be to ensure that pre-commencement conditions are "only imposed by local planning authorities where they are absolutely necessary".

Mike Kiely, Chair of the Voard of the Planning Officers Society, added that for some multi-phase schemes the conditions can be packaged up and repeated for each phase, which, he said, is generally a practice welcomed by developers.

In some instances, imposing pre-commencement conditions on a permission can be a proactive way for councils to approve - rather than kick out - applications that lack sufficient details on certain key points, said Kiely.
