Sunset clause removes threat hanging over LPAs

Last week Ministers announced they would not extend beyond the end of April a temporary appeal mechanism that allows developers to challenge "unviable" affordable housing obligations. The "sunset clause" means that the operation of the mechanism would cease on 30 April 2016.

Graham Jones, the Planning Officers Society's s106 & Infrastructure Delivery Subject Specialist, told a Planning magazine reporter the move should put authorities in a stronger position when it comes to agreeing affordable housing levels, adding: "They haven't got that threat hanging over them."
