Duty to cooperate legal test a serious affair

The High Court's decision to throw out a Hertfordshire authority's legal bid to overturn an inspector's verdict that it did not meet the duty to cooperate in drawing up its draft plan underlines the seriousness with which local planning authorities need to treat the legal test, reports Planning magazine.

Catriona Riddell, strategic planning specialist at the Planning Officers Society, said: "It's clear from this that to demonstrate positive collaboration, it can't just be about the number of meetings you've attended. Even if you don't agree, you have to set out a plan of action, an agreed way forward."
