In response to a number of queries on the Government's new cross strategy Phil Kirby for POS said planners are already delivering on many aspects of the health agenda, in terms of ensuring adequate public open space, opportunities for walking and cycling etc.

He went on to express reservations with the suggestion that LPAs can use their planning powers to control the number of fast food outlets near schools and parks. Whilst currently these would be considered against issues such as loss of retail floorspace, amenity (noise,smell,fumes, and general disturbance), adequacy of parking etc, to suggest that we could resist on the basis of preventing access by a particular client group, would in my opinion take it beyond the scope of planning, and therefore we would struggle to use this as an argument currently.
