Environmental Impact Assessment (Agriculture) (England) Regulations

The proposed EIA Regulations are silent on the consultation imperative of the background Directive. It is unclear whether the authors take for granted the requirement to be more open and inclusive or are unaware of the need to be so. Given the background of Lord Haskins’ Review, the newness of Natural England (assumed to be the authority appointed to run the EIA rules) and the links between land management, natural resource protection and land-use planning, it will be important to secure the involvement of a wide range of stakeholders in implementing the Regulations. Amongst the key players are the Environment Agency and local authorities (in their roles as planning/highways/waste authorities and community leaders).
