This response on behalf of the Planning Officer's Society (POS) relates to taking forward the Killian Pretty Review: Annex A - Development Management Framework - Consultation Exercise.

Development Management Framework: Detailed Guidance / Policies

In respect of the table on page 7 it is noted that the "special regimes" section has omitted telecoms, trees, Listed Building Consent and Habitats Directive. It is suggested that the "special regimes" should be incorporated into the other sections because they should all be subject to the same development management process. For example, Local Authority's own development or minerals and waste should go through the same DM process as other development.

Whilst it is appreciated that at present there are separate policy documents that deal with these types of development, the paragraphs or chapters dealing with each element of the process could be extrapolated into the other relevant sections of the framework such as "Consultation" or Appeals. This would make re-drafting easier in the future and would not perpetuate the anomaly.

It is also considered that "enforcement" should fall within "monitoring" not delivery and that reference should be made to enforcement in the "pre-application" section, as it is investigation of potential breaches of planning control that can often initiate the development management process.
